1. PORTABLE DEVICES


You must have a mobile communications subscription with a participating carrier or have access to a mobile communications network for Typical Media Group to make the Typical Media Group Internet Service available, as well as any carrier services required to download content, to (a) upload content to this Typical Media Group’s/TMG/Typical Media’s Websites using your mobile device and/or tablet, (b) receive and reply to messages, or to access or make posts using text messaging, (c) browse this Typical Media Group’s/TMG/Typical Media’s Websites from your mobile device, and/or (d) access certain features through a mobile application you have downloaded and installed on your mobile device (collectively, the “Mobile Services”). The terms and conditions of this Agreement will apply to any new or additional features, including the distribution of new goods and services, that improve or complement the present Typical Media Group Internet Service unless otherwise specified. You agree to abide by all applicable laws when using the Typical Media Group Internet Service.

2. Modifications to this Agreement


This Agreement and/or the Additional Terms may be modified, altered, or changed at any time by Typical Media Group, at its sole discretion. Any changes will be announced on this Typical Media Group’s/TMG/Typical Media’s Websites by Typical Media Group. For updates, please frequently examine this Agreement and/or the Additional Terms. You agree to be bound by these modifications without restriction or qualification by using this Typical Media Group’s/TMG/Typical Media’s Websites and/or Typical Media Group Internet Service going forward. 8. Exceptions

You consent to assist Typical Media Group to the fullest extent possible in advancing any defenses that may be available about a claim for which you are liable under this Agreement.

11. CHANGE OR END BY TYPICAL MEDIA OR TYPICAL MEDIA GROUP


At any time, for any reason, with or without prior notice to you, Typical Media Group retains the right, in its sole discretion, to alter, suspend, or terminate this Typical Media Group’s/TMG/Typical Media’s Websites and/or any portion thereof, including any Typical Media Group Internet Service, and/or your account, password, or use of any Typical Media Group Internet Service.

21. Features for Voting Rating & Scoring

Any votes or ratings that you provide that exceed any specified threshold will be eliminated. It is not permitted to provide money or receive anything in return for votes or ratings. 24. MEMBER PASSWORD AND ACCOUNT


Any membership name and password that you choose to link to your account when you register are your responsibility. You undertake to alert us right once of any unauthorized use of your account, and you are solely liable for any activities that take place under it.

26. Refunds

29. INDICATING ARBITRATION

Any disagreement, allegation, or cause of action about this Agreement, any Additional Terms, this Typical Media Group’s/TMG/Typical Media’s Websites, the Privacy Statement, or any related matters, shall be settled through arbitration administered by JAMS Comprehensive Arbitration Rules and Procedures in  Miami, Florida. Three arbitrators will preside over the arbitration; they will be chosen from among retired judges and attorneys licensed to practice law in the state where the arbitration is being held. This Agreement shall take precedence over any conflicting provisions or aspects of the JAMS Rules. The arbitrator’s ruling will be definitive and enforceable. The parties may request and the arbitrators may grant any kind of remedy that would be permitted by the relevant legislation. Unless relevant legislation requires a different allocation of costs for this arbitration provision to be enforceable, the JAMS Rules will control the payment of arbitration fees. As long as an arbitrator finds that your claim is not baseless or that it was filed for an improper reason, we will take into consideration your request for reimbursement if you are unable to pay your portion of the arbitration fees.

You hereby acknowledge and agree to the irrevocable waiver of your right to a jury trial or to litigate your claim in court. You also acknowledge that arbitration may limit your rights to discovery and appeals. By entering into this agreement and accepting its benefits, you knowingly assume this risk.

Notwithstanding the foregoing, IF ALLOWED BY THE RULES OF THAT SMALL CLAIMS COURT AND IF WITHIN SUCH COURT’S JURISDICTION, EITHER PARTY MAY BRING ITS CLAIM IN ITS LOCAL SMALL CLAIMS COURT.

30. Waiver of Class Action


If you are a resident of the United States, you and Typical Media Group each agree that any disagreements, claims, and causes of action relating to this Agreement, the Additional Terms, this Typical Media Group’s/TMG/Typical Media’s Websites, the Privacy Statement, or their respective matters, shall be settled individually without the use of class, consolidated, private attorney general, or representative actions. To the maximum extent allowed by relevant law, you and we agree to give up any right to initiate or take part in such an action in court or arbitration. The laws of the Flordia, as they apply to agreements entered into and to be performed completely within such state, shall govern, interpret, and enforce this Agreement and any Additional Terms, without regard to conflict of law principles. For any cause of action arising out of this Agreement, you consent to submit to the personal jurisdiction of the courts of Flordia. You commit to bringing any legal action about this Agreement within a year of the cause of action’s emergence. You acknowledge that any claim brought after this date is ineligible for relief.

The arbitration, class action waiver, warranty disclaimers, and liability limitations are just a few examples of the reasons why any provision of this agreement, or its application to any person or circumstance, may be deemed invalid or unenforceable. In such a case, the affected provision will be deemed stricken or replaced by a valid, enforceable provision that, to the greatest extent possible, closely resembles the original provision. All other provisions of this agreement will remain in full force and effect. Any condition or right under this Agreement shall not be deemed waived by either party’s omission to require strict performance of any such provision. You also agree not to use, nor to authorize the use of, any Intellectual Property or contact details, personal identifiers, metadata processes, source codes, algorithms or other data on the Typical Media Group’s/TMG/Typical Media’s Websites, Typical Media Group’s platforms, or Typical Media Group’s services (the “Typical Media Group Data” and together with the Intellectual Property, the “Typical Media Group IP & Data”): (i) to create, train (whether directly or indirectly) and/or improve any generative or other artificial intelligence and/or machine learning models, applications, systems or technologies and any datasets therefor, whether now existing or hereafter created, in any manner, means or media and/or for any purpose whatsoever (e.g., machine learning, generative technology, data mining, cognitive computing, natural language processing, natural learning processes, computer vision, etc.) (“AI Technology”) and/or (the All cryptocurrency and blockchain systems and assets (e.g., NFTs, bitcoin, wallets, etc.) ( “Blockchain Technology”); (ii)  to create, generate, edit, reproduce, translate, copy, publicly perform, distribute, transmit, adapt, modify, create any simulations and/or derivative works of, and/or manipulate, any Typical Media Group IP & Data nor (iii) to design, enable and/or otherwise be utilized for any AI Technology mimicking, replicating and/or simulating human appearance, thought processes, speech, emotions or actions; (iv) extract, scrape, harvest or collect any Typical Media Group IP & Data for use in connection with AI Technology and/or Blockchain Technology or otherwise; (v) discover, reverse engineer, decompile, disassemble, or attempt to derive Typical Media Group IP & Data source code or algorithms; (vi) process, collect, arrange or otherwise use Typical Media Group IP & Data into or in connection with datasets that are or may be used to train or otherwise in connection with AI Technology and/or Blockchain Technology; nor (vii) otherwise in connection with any AI Technology and/or Blockchain Technology.  

32.  NOTICE OF COPYRIGHT AND TRADEMARK

Copyright, trademark, and other laws of the United States, as well as international conventions and the laws of other countries, protect the Typical Media Group’s/TMG/Typical Media’s Websites and all of its contents, including but not limited to articles, other text, photographs, images, illustrations, graphics, software, video material, audio material, including musical compositions and sound recordings, and software. Intellectual property also includes the Typical Media Group logos, titles, characters, names, graphics, and button icons. Typical Media Group is the owner or controller of the intellectual property, or other parties may do so on Typical Media Group’s behalf.

Without the express written permission of Typical Media Group, you agree not to: reproduce, download, license, publish, enter into a database; display, modify, create derivative works from, transmit, post, distribute, or perform publicly by any means, method, or process now known or later developed; decompile, reverse engineer, disassemble, use on another computer-related environment; transfer or sell any intellectual property, information, software, or products obtained from or through this Typical Media Group’s/TMG/Typical Media’s Websites, in whole or in part.
